These Terms of Service (“Terms”) govern the use of hosting services (“Services”) provided by Vladyslav Kudriavtsev, trading as ALBAHOST, a sole trader registered in the United Kingdom (“we”, “us”, “our”).
By purchasing or using our Services through bereg.pro or any of its subdomains (including but not limited to my.bereg.pro) (collectively the “Website”), you (“you”, “your”, “Customer”) agree to be bound by these Terms.
1. Services Provided
1.1. We provide web hosting, domain registration, and related services as described on our Website.
1.2. The scope of each service is defined by the plan selected by you.
1.3. We may update, improve, or modify Services from time to time, provided such changes do not materially reduce functionality.
2. Account Registration
2.1. You must provide accurate and complete information during registration and keep it up to date.
2.2. You are responsible for all activity under your account.
2.3. You must keep your login credentials secure and confidential.
3. Acceptable Use
3.1. You agree not to use the Services for:

Sending spam, phishing, or bulk unsolicited emails.

Hosting illegal content, including but not limited to malware, copyrighted material without permission, or abusive content.

Activities that may harm the security or stability of our network (including DDoS attacks, mining, or hacking tools).
3.2. We reserve the right to suspend or terminate Services without notice if you breach this policy.
4. Fees and Payments
4.1. Fees are payable in advance, according to the plan selected.
4.2. Payments are processed via Stripe, PayPal, or other available gateways.
4.3. Services renew automatically unless cancelled before the renewal date.
4.4. If payment is not received, your account may be suspended or terminated.
5. Refund and Cancellation
5.1. Consumers in the UK/EU have the right to cancel within 14 days of purchase (cooling-off period).
5.2. By activating the hosting service, you acknowledge that the right to cancellation may be waived once the service has started.
5.3. Refunds outside of the statutory rights are at our sole discretion.
6. Service Availability and Support
6.1. We aim to provide 99.9% uptime based on server monitoring, excluding scheduled maintenance and factors beyond our control.
6.2. Support requests are handled as soon as possible, typically within 24 hours.
7. Data Protection and Privacy
7.1. We process personal data in accordance with UK GDPR and EU GDPR.

7.3. You remain the data controller for any data stored on your hosting account.
8. Disclaimer of Warranties and Limitation of Liability
8.1. The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
8.2. To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, punitive, exemplary, or special damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunities.
8.3. Our total liability in respect of any claims shall not exceed the total fees paid by you for the Services during the twelve (12) months immediately preceding the claim.
8.4. Nothing in these Terms shall exclude or limit liability where such exclusion or limitation is not permitted by applicable law.
9. Termination
9.1. You may cancel at any time via your client area.
9.2. We may terminate Services with notice if you breach these Terms.
9.3. Upon termination, your data will be deleted after 40 days unless required by law to retain it longer.
10. Force Majeure
We shall not be held responsible for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, war, civil unrest, labour disputes, internet or telecommunication failures, or third-party service interruptions.
11. Governing Law
11.1. These Terms shall be governed by the laws of Scotland.
11.2. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
